§ 1 DEFINITIONS

Working days – days from Monday to Friday except public holidays.

Account – a free-of-charge function of the Store (service provided electronically) regulated by separate regulations, thanks to which the Buyer may set up his individual Account in the Store.

Consumer – a Consumer within the meaning of the provisions of the Civil Code.

Buyer – any entity purchasing from the Shop.

Rules and Regulations – these Rules and Regulations.

§ 3 TECHNICAL REQUIREMENTS 1.

For the proper functioning of the Shop you need:

1. a device with access to the Internet

2. internet browser supporting JavaScript and cookies. 2.

2) In order to place an order in the Shop, apart from the requirements specified in paragraph 1, it is necessary to have an active e-mail account.

§ 4 SHOPPING IN THE STORE

(1) Prices of goods shown in the Store are the total prices for the goods, including VAT.

(2) The Seller points out that the total price of an order consists of the price of goods indicated in the Store and, if applicable, the cost of delivery of goods.

(3) The goods selected for purchase should be added to the shopping cart in the Store.

(4) The Buyer then chooses from the available in the Store: the method of delivery of the goods and the method of payment for the order, and provides the data necessary to complete the order placed.

(5) The order is placed when the Buyer confirms its contents and accepts the Terms and Conditions.

6th Placing an order is tantamount to concluding a sales contract between the Buyer and the Seller.

(7) The Seller shall provide the Consumer with confirmation of the conclusion of the contract of sale on a durable medium at the latest upon delivery of the goods.

(8) The Buyer may register with the Store, i.e. create an Account therein or make purchases without registering by providing his/her data with each order.

§ 5 PAYMENTS

An order may be paid for, depending on the Buyer’s choice:

1. PayPal

2. traditional bank transfer

§ 6 ORDER PROCESSING

The Seller is obliged to deliver goods without defects. 2.

(2) The lead time of the order is indicated in the Shop.

Third In the event that the Buyer has chosen to pay in advance for the order, the Seller shall proceed to carry out the order after it has been paid.

4th In the event that the Buyer has purchased goods with different lead times within one order, the order will be processed within the time limit applicable to the goods with the longest lead time.

5th Goods are delivered exclusively in the territory of the Republic of Poland. 6.

(6) Goods purchased in the Store are delivered depending on the method of delivery chosen by the Buyer:

1. through the Polish Post or by courier

§ 7 RIGHT OF WITHDRAWAL

(1) The consumer has the right to withdraw from the contract concluded with the Seller through the Shop, subject to § 8 of the Terms and Conditions, within 14 days without giving any reason.

(2) The term of withdrawal shall expire after 14 days from the date:

1. on which the Consumer came into possession of the goods or on which a third party other than the carrier and indicated by the Consumer came into possession of the goods.

(2) On which the Consumer has taken possession of the last of the goods or on which a third party, other than the carrier and indicated by the Consumer, has taken possession of the last of the goods in the case of a contract involving the transfer of ownership of multiple items which are delivered separately.

(3) In order for the Consumer to exercise his/her right of withdrawal, he/she must inform the Seller, using the data provided in § 2 of the Terms and Conditions, of his/her decision to withdraw from the contract by an unequivocal statement (for example, a letter sent by post or information transmitted by e-mail).

(4) The consumer may use the model withdrawal form at the end of the Terms and Conditions, but it is not obligatory.

(5) In order to meet the withdrawal deadline, it is sufficient for the Consumer to send information concerning the exercise of his or her right of withdrawal before the expiry of the withdrawal period.

6. EFFECTS OF WITHDRAWAL

(7) In the event of withdrawal from the concluded contract, the Seller shall reimburse to the Consumer all payments received from the Consumer, including the costs of delivery of the goods (except for additional costs arising from the method of delivery chosen by the Consumer other than the cheapest ordinary method of delivery offered by the Seller), immediately and in any case no later than 14 days from the day on which the Seller was informed of the Consumer’s decision to exercise the right of withdrawal.

(8) The Seller shall refund the payment using the same means of payment that were used by the Consumer in the original transaction, unless the Consumer agrees to a different solution, in any case the Consumer shall not incur any fees in connection with the refund.

(9) The Seller may withhold reimbursement until it has received the goods or until it has been provided with proof of return, whichever event occurs first.

(10) The Seller asks to return the goods immediately and in any case no later than 14 days from the day on which the Consumer informed the Seller of the withdrawal from the sales contract. The deadline is met if the Consumer sends back the goods before the expiry of the 14-day period.

(11) The consumer shall bear the direct costs of returning the goods.

(12) The consumer shall only be liable for any diminution in the value of the goods resulting from the use of the goods other than what was necessary to ascertain the nature, characteristics and functioning of the goods.

(13) If the goods, due to their nature, cannot be sent back in the usual way by post the Consumer shall also have to bear the direct costs of returning the goods. The estimated amount of these costs the Consumer will be informed by the Seller in the description of the goods in the Shop or when placing the order.

(14) In the event that a refund is necessary for a transaction made by the Consumer by payment card, the Seller shall make the refund to the bank account assigned to the Buyer’s payment card.

§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

(1) The right of withdrawal from a contract concluded at a distance shall not be granted to the Consumer in respect of a contract:

1. in which the object of the performance is a non-refabricated thing, produced according to the Consumer’s specifications or serving to satisfy his individualised needs.

(2) In which the object of the performance is an item that is perishable or has a short shelf life.

(3) In which the subject of the performance is an item supplied in sealed packaging which cannot be returned after opening for health or hygiene reasons, if the packaging has been opened after delivery.

(4) In which the object of the performance is things which, after delivery, by their nature, become inseparable from other things.

(5) In which the subject matter of the performance is sound or visual recordings or computer programs delivered in sealed packaging if the packaging has been opened after delivery.

(6) In which the supply of newspapers, periodicals or magazines is involved, with the exception of a subscription contract.

7. where the price or remuneration is dependent on fluctuations in the financial market which are beyond the trader’s control and may occur before the end of the withdrawal period.

(8) The supply of digital content which is not recorded on a tangible medium where performance has begun with the consumer’s express consent before the end of the withdrawal period and after the trader has informed the consumer of the loss of the right of withdrawal.

(2) The right of withdrawal from a distance contract is not granted to an entity other than the Consumer.

§ 9 COMPLAINTS

(1) In the event of a defect in the goods, the Buyer has the opportunity to claim faulty goods on the basis of the warranty regulated by the Civil Code or the guarantee, if a guarantee was granted.

(2) Using the warranty, the Buyer may, under the terms and within the time limits specified in the Civil Code:

1. make a declaration of price reduction

2. in the case of a material defect – make a declaration of withdrawal from the contract

3. demand to replace the item with a defect-free item

4. request the removal of the defect

(3) The Seller asks for complaints on the basis of the warranty to the postal or electronic address specified in § 2 of the Terms and Conditions.

4th If it turns out that in order to consider the complaint it is necessary to deliver the advertised goods to the Seller, the Buyer is obliged to deliver these goods, in the case of a Consumer at the expense of the Seller.

(5) If there is an additional guarantee on the goods, information about it and its conditions is available in the product description in the Store.

(6) Complaints regarding the operation of the Store should be sent to the e-mail address specified in § 2 of the Terms and Conditions.

7th Complaints will be considered by the Seller within 14 days.

§ 10 PERSONAL DATA

First Personal data provided by the Buyer during the use of the Shop is administered by the Seller. 2.

(2) The Buyer’s personal data shall be processed on the basis of the agreement and for the purpose of its implementation, in accordance with the principles set out in the General Regulation of the European Parliament and of the Council (EU) on data protection (RODO). Detailed information on the processing of data by the Seller is contained in the privacy policy posted in the Shop.

§ 11 DISCLAIMERS

(1) The provision of unlawful content by the Buyer is prohibited.

(2) Each order placed in the Shop constitutes a separate contract of sale and requires a separate acceptance of the terms and conditions. The contract is concluded for the time and purpose of fulfilling the order.

(3) Contracts concluded under these terms and conditions shall be concluded in the Polish language.

4th In the case of a possible dispute with the Buyer who is not a Consumer, the competent court shall be the court with jurisdiction over the seat of the Seller.

5th None of the provisions of these terms and conditions does not exclude or in any way limit the rights of the Consumer under the law.

§ 3 TECHNICAL REQUIREMENTS

1. for the proper functioning and creation of an Account you need:

1. an active e-mail account

2. a device with access to the Internet

3. a web browser that supports JavaScript and cookies

§ 4 ACCOUNT

The creation of an Account is entirely voluntary and depends on the will of the Buyer. 2.

(2) Account gives the Buyer additional opportunities, such as: viewing the history of orders placed by the Buyer in the Store, checking the status of the order or self-editing Buyer’s data.

(3) In order to set up an Account, you must complete the appropriate form in the Store.

4th The moment an Account is created, an agreement is concluded for an indefinite period of time between the Buyer and Seller to operate the Account under the principles indicated in the Rules and Regulations.

5th The buyer may without any costs at any time to resign from the Account.

6. in order to resign from the Account, one should send his resignation to the Seller at the e-mail address: lamps@sielacz.com, which will result in the immediate deletion of the Account and the termination of the contract for the Account.

§ 5 COMPLAINTS

(1) Complaints regarding the operation of the Account should be sent to the e-mail address lamps@sielacz.com.

The Seller shall consider a complaint within 14 days.

§ 6 PERSONAL DATA

First The administrator of personal data provided by the Buyer when using the Shop is the Seller. 2.

(2) The Buyer’s personal data shall be processed on the basis of the agreement and for the purpose of its implementation, in accordance with the principles set out in the General Regulation of the European Parliament and of the Council (EU) on data protection (RODO). Detailed information on the processing of data by the Seller is contained in the privacy policy posted in the Shop.

§ 7 DISCLAIMERS

(1) The provision of unlawful content by the Buyer is prohibited.

(2) The Agreement for maintaining an Account shall be concluded in the Polish language.

(3) In the event of the occurrence of important reasons referred to in paragraph 4, the Seller shall have the right to amend these terms and conditions of the Account.

4th The important reasons referred to in paragraph 3 shall be:

1. the need to adapt the Store to the laws applicable to the operation of the Store

2. improvement of security of the service provided

3. change the functionality of the Account requiring a modification of the Account regulations.

5th Buyer shall be informed of the planned change to the regulations of the Account at least 7 days before the change comes into effect through an e-mail sent to the address assigned to the Account.

6th In the event that the Buyer does not agree with the planned change, he should inform the Seller by sending an appropriate message to the Seller’s e-mail address lamps@sielacz.com, which will result in termination of the agreement for the provision of an Account from the moment the planned change comes into force, or earlier if the Buyer submits such a request.

(7) If the Buyer does not object to the planned change by the time it comes into force, it is assumed that he accepts it, which does not constitute any obstacle to the termination of the agreement in the future.

8th In the event of any dispute with the Buyer who is not a Consumer, the competent court shall have jurisdiction over the Seller’s registered office.

9th None of the provisions of these terms and conditions does not exclude or in any way limit the rights of the Consumer under the law.
