§ 1 Definitions

Working days – days from Monday to Friday, except public holidays.

Account – regulated by separate regulations free function of the Store (service provided electronically), thanks to which the Buyer can create in the Store his individual Account.

Consumer – Consumer within the meaning of the Provisions of the Civil code.

Buyer – each entity of the Buyer in the Store.

Terms and Conditions – these terms and conditions.

Shop – sielacz online store run by the Seller at the address https://sielacz.com.

Seller – MICHAŁ SIEŁACZ, entrepreneur conducting business under the name SIELACZ Michał Siełacz, entered in the Central Register and Information on Economic Activities conducted by the Minister of Development and Finance, NIP 2530204800, Nr REGON 367869009, ul. National Unity 2b/4, 72-315 Resko.

§ 3 Technical Requirements

  1. For the proper functioning of the shop you need:
    1. A device with internet access
    1. A Web browser that supports JavaScript and cookies.
  2. For placing an order in the store, in addition to the requirements referred to in paragraph 1. 1, an active e-mail account is required.

§ 4 Shop

  1. The prices of goods shown in the store are the total prices for goods, including VAT.
  2. The seller notes that at the total price of the order are made in the store: the price for the goods and, if applicable, the delivery costs of the goods.
  3. The item you want to buy is added to your shopping cart.
  4. The buyer then chooses from the available store the delivery method and the payment methods of the order, as well as the data necessary to complete the order.
  5. The order is placed upon confirmation of the content and acceptance of the terms and conditions by the buyer.
  6. Placing an order is synonymous with the conclusion of a sale agreement between the buyer and the seller.
  7. The seller shall provide the consumer with a confirmation of the conclusion of the contract of sale on a durable medium at the latest when the goods are delivered.
  8. The buyer can register in the shop TJ. Create an account in it or make purchases without registration by providing your data with each order.

§ 5 Payments

  1. You can pay for a placed order, depending on the choice of the buyer:

§ 6 Order Processing

  1. The seller is obliged to deliver the goods without defects.
  2. The delivery date is indicated in the store.
  3. In the event that the buyer has selected the payment in advance for the order, the seller will proceed to order completion after his payment.
  4. In the event that the purchaser purchases goods with different delivery dates within a single order, the order will be processed within the time limit for the goods having the longest time.
  5. The goods are delivered exclusively to the territory of the Republic of Poland.
  6. Goods purchased from the store are delivered depending on which delivery method the buyer has chosen:

§ 7 Right of withdrawal

  1. The consumer has the right to withdraw from the contract concluded with the seller through the store, subject to § 8 of the terms and conditions, within 14 days without giving any reason.
  2. The time limit for withdrawal will expire after 14 days from:
    1. In which the consumer came into possession of the goods or where the third person other than the carrier and indicated by the consumer entered into the possession of that goods.
    1. In which the consumer came into possession of the last of the goods, or in which a third party, other than the carrier and indicated by the consumer, entered into the possession of the last of the things in the case of a which wrongdoer agreement to transfer ownership of many things are supplied separately.
  3. In order for the consumer to exercise the right of withdrawal, he must inform the seller, using the data provided under § 2 of the terms of use, of his decision to withdraw from the agreement by means of an explicit statement (for example, a letter sent by post or information e-mail).
  4. The consumer may use the model withdrawal form at the end of the regulations, but this is not obligatory.
  5. In order to maintain the withdrawal period, it is sufficient for the consumer to send information concerning the exercise of his right of withdrawal before the expiry of the withdrawal period.
  6. Effects of withdrawal
  7. In the event of a withdrawal from an agreement concluded, the seller shall return to the consumer all payments received from him, including the costs of delivering the goods (except for the additional costs arising from the consumer’s choice of delivery other than The cheapest usual delivery method offered by the seller), immediately and in any case no later than 14 days from the date on which the seller was informed of the consumer’s decision to exercise the right of withdrawal.
  8. Reimbursement of payments, the seller shall make use of the same means of payment as the consumer used in the original transaction, unless the consumer agrees to another solution, in any case the consumer will not incur any fees in connection with This return.
  9. The seller may withhold the reimbursement of payment until the goods are received, or until they have been provided with proof of his return, whichever occurs first.
  10. The seller asks to return the goods to the following address: UL. National Unity 2b/4, 72-315 Resko immediately, and in any event not later than 14 days from the date on which the consumer informed the seller of the withdrawal from the contract of sale. The deadline is maintained if the consumer sends the goods before the expiry of the period of 14 days.
  11. The consumer bears the direct cost of returning the goods.
  12. The consumer shall be responsible only for reducing the value of the goods resulting from the use of it in a manner other than that which was necessary to ascertain the nature, characteristics and functioning of the goods.
  13. If the goods by their nature cannot be sent back in the ordinary mail mode the consumer will also have to bear the direct cost of returning the goods. With the estimated amount of these costs, the consumer will be informed by the seller in the description of the goods in the shop or when placing the order.
  14. Should a refund be required for a transaction made by the customer by credit card, the seller has made a refund to the bank account assigned to the buyer’s payment card.

§ 8 Exceptions to the right to withdraw from the agreement

  1. The right of withdrawal from a distance contract is not granted to the consumer in relation to the contract:
    1. In which the subject of the performance is a prefabricated item produced according to the consumer’s specification or serving the satisfaction of its individualised needs.
    1. In which the subject of the performance is perishable or has a short shelf life.
    1. In which the subject matter of the service is provided in a sealed package which, after opening the package, cannot be returned due to health protection or hygienic reasons, if the packaging has been opened after delivery.
    1. In which the subject of the provision are things which, after delivery, by their nature, are inseparably connected with other items.
    1. In which the subject of the provision are sound or visual recordings or computer programs delivered in a sealed package, if the packaging was opened after delivery.
    1. For the supply of newspapers, periodicals or periodicals, except for subscription contracts.
    1. In which the price or remuneration depends on fluctuations on the financial market, over which the trader has no control, and which may occur before the expiry of the time-limit for withdrawal.
    1. For the supply of digital content which is not recorded on a tangible media, if the performance of the benefit started with the consumer’s express consent before the expiry of the withdrawal period and after the trader has been informed of the loss of rights Withdrawal.
  2. The right of withdrawal from a distance contract shall not be granted to any other party than the consumer.

§ 9 Complaints

  1. In the event of a defect in the goods, the buyer has the possibility to advertise the defective product on the basis of the statutory warranty or guarantee provided in the Civil Code, as far as the warranty is given.
  2. The buyer may, on the basis of the terms and within the time limits specified in the Civil Code:
    1. Submit a statement to reduce the price
    1. When defect material, make a statement of withdrawal from the agreement
    1. Require replacement of things for defect-free
    1. Request removal of defects
  3. The seller requests to submit a complaint on the basis of the warranty on the postal or electronic address indicated in § 2 of the terms and conditions.
  4. If it is found that for consideration of the complaint it is necessary to provide the advertised goods to the seller, the buyer is obliged to deliver the goods, in the case of the consumer at the seller’s expense, to the address ul. National Unity 2b/4, 72-315 Resko.
  5. If the merchandise has been given an additional warranty, information about it, and its terms, is available in the product description in the store.
  6. Complaints regarding the operation of the shop should be directed to the e-mail address specified in § 2 of the terms.
  7. The seller will process the complaint within 14 days. OUT-OF-COURT COMPLAINT AND REDRESS PROCEDURES
  8. If the complaint does not bring the consumer’s expected result, the consumer may use m.in. Z:
    1. Mediation carried out by the competent Provincial inspectorate for Trade Inspection to which a request for mediation has to be made. In principle, the procedure is free of charge.
    1. assistance of an appropriate, land-standing amicable consumer court operating at the provincial Inspectorate of the commercial inspection, to which the application for consideration before the arbitration Court is to be lodged. In principle, the procedure is free of charge.
    1. Free assistance of the municipal or district consumer Ombudsman.

§ 10 Personal Data

  1. The administrator of the personal data provided by the buyer when using the shop is the seller.
  2. The buyer’s personal data are processed under the agreement and for the purpose of its execution, in accordance with the principles set out in the general Regulation (EU) on data protection of the European Parliament and of the Council (RODO). For details on how the data is processed by the seller, please refer to the Privacy policy posted in the store.

§ 11 Reservations

  1. The buyer is prohibited from providing illegal content.
  2. Each order placed in the store is a separate sale agreement and requires a separate acceptance of the terms and conditions. The contract is concluded on time and for the purpose of fulfilling the contract.
  3. Contracts concluded under these terms and conditions shall be concluded in the Polish language.
  4. In the event of a possible dispute with a buyer who is not a consumer, the competent court will be the jurisdiction of the seller’s seat.
  5. Nothing in these terms and conditions shall exclude or in any way restrict the consumer’s rights under the legislation.

§ 3 Technical Requirements

  1. For the proper functioning and establishment of an account, you need:
    1. Active e-mail account
    1. A device with internet access
    1. A Web browser that supports JavaScript and cookies

§ 4 Account

  1. Creating an account is entirely voluntary and dependent on the will of the buyer.
  2. The account gives the buyer additional opportunities, such as viewing the history of orders placed by the buyer in the store, checking the status of the order or self-editing the buyer’s data.
  3. To set up an account, please fill in the appropriate form in the store.
  4. At the time of the establishment of an account is concluded for an indefinite period between the buyer and the seller, the agreement in the field of conducting an account on the principles specified in the regulations.
  5. The buyer may, without incurring any costs, cancel the account at any time.
  6. In order to cancel your account, you must send your resignation to the seller by email: michal@sielacz.com, which will result in the deletion of your account immediately and termination of your account agreement.

§ 5 Complaints

  1. Complaints about the operation of the account should be directed to the e-mail address michal@sielacz.com.

  3. Where the complaint does not bring the consumer’s expected result, the consumer may benefit from the m.in. Z:

§ 7 Reservations

  1. The buyer is prohibited from providing illegal content.
  2. The agreement for the conduct of the account is concluded in English.
  3. Where there are compelling reasons referred to in paragraph 1. 4, the seller has the right to change these terms and conditions of the account.
  4. Important reasons referred to in paragraph 1. 3 are:
    1. The necessity of adjusting the shop to the law applicable to the store’s activities
    1. Improving the security of the service provided
    1. Change of account functionality requiring modification of the account rules.
  5. The buyer will be informed of the planned change of the terms of the account at least 7 days prior to the change in effect by email sent to the address assigned to the account.
  6. If the buyer does not agree to the planned change, he/she should inform the seller by sending the appropriate message to the email address of michal@sielacz.com, resulting in termination of the Agreement on To keep an account at the time of the planned change or earlier if the buyer reports such a request.
  7. In the event that the buyer does not object to the planned amendment until its entry into force, it is assumed that he accepts it, which does not constitute any obstacle to the termination of the contract in the future.
  8. In the event of a possible dispute with a buyer who is not a consumer, the competent court will be the jurisdiction of the seller’s seat.
  9. Nothing in these terms and conditions shall exclude or in any way restrict the consumer’s rights under the legislation.
